1. Conditions of Use

By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website accordingly. The Last Codebender LLC only grants use and access of this website, its products, and its services to those who have accepted its terms.

2. Privacy Policy

Before you continue using our website, we advise you to read our privacy policy regarding our user data collection. It will help you better understand our practices.

3. Age Restriction

You must be at least 18 years of age before you can use this website. By using this website, you warrant that you are at least 18 years of age and you may legally adhere to this Agreement. The Last Codebender LLC assumes no responsibility for liabilities related to age misrepresentation.

You grant The Last Codebender LLC a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.

Any dispute related in any way to your visit to this website or to products you purchase from us shall be arbitrated by state or federal court in Delaware and you consent to exclusive jurisdiction and venue of such courts.

You agree to indemnify The Last Codebender LLC and its affiliates and hold The Last Codebender LLC harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

10. Limitation on Liability

The Last Codebender LLC is not liable for any damages that may occur to you as a result of your misuse of our website.

The Last Codebender LLC reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between The Last Codebender LLC and the user, and this supersedes and replaces all prior agreements regarding the use of this website.

11. Refund Policy

We are committed to providing you with comprehensive support throughout the Program. Your success is important to us, and we offer a fair refund policy based on mutual engagement.

The Program is a comprehensive coaching program designed to help you launch and scale your AI agency. Because of the intensive support and resources provided, we offer a performance-based refund policy — designed to protect clients who commit fully, implement consistently, and still don't achieve results.

To be eligible for a full refund, the following conditions must be met:

  • Active Participation & Communication: You agree to engage proactively throughout the program. This includes attending and engaging in at least ten (10) Q&A sessions, participating in at least five (5) biweekly challenges in the community, and posting all required milestone updates in the community. If we do not hear from you for fourteen (14) consecutive days without prior notice, your refund eligibility is void, as we cannot track your progress or provide proper support.
  • Training Completion: You must complete the entire incubator program curriculum and notify our support team upon completion. This ensures you have the full foundation needed for implementation.
  • Execution & Proof of Work: You must implement the strategies taught in the program with clear, consistent action. This includes:
    • Reaching out to at least 200 potential clients using our provided outreach strategy
    • Building and sharing at least three (3) AI solution demos as specified
    • Creating your agency website and professional profiles according to program guidelines
    • Publishing at least fifteen (15) content pieces (LinkedIn posts, YouTube videos, case studies, etc.) following program guidelines
    • Conducting all sales calls using our sales process (all calls must be recorded and tracked)
    • All work must be documented and available for verification upon request
  • Checkpoints & Support Use: You must reach out for positioning and strategy review before beginning client outreach, and communicate any business development challenges to us at least sixty (60) days before the end of the 6-month guarantee period. This allows our team sufficient time to provide guidance and course corrections.
  • Refund Request: If all conditions are met and you have not secured at least one paying client within six (6) months of enrollment, you may submit a refund request. The request must include:
    • Our completed refund eligibility form
    • Documentation of client outreach, prospect meetings, proposals, sales recordings, and marketing materials
    • Participation in a mandatory verification call with our team

This policy protects serious clients who commit fully to the program. If you do the work as outlined and still don't land a client, you may be eligible for a refund. However, if you show inconsistent participation, fail to follow the systems taught, or don't meet all eligibility criteria, your refund request will be denied.

Refund requests can only be submitted once, after the 6-month period, and must include all required documentation. We reserve the right to deny any request that does not meet all listed criteria.

12. Course Materials

The course materials provided by The Last Codebender LLC are for personal use only. You agree not to share, distribute, or resell any course materials to individuals who are not enrolled in the course. Violation of this policy may result in immediate termination of your access to the course and potential legal action.

13. Changes to Terms of Service

We reserve the right to modify these terms of service at any time. We do not guarantee to provide notice of changes, so please check this page periodically for any updates. By continuing to access or use our website after any revisions become effective, you agree to be bound by the revised terms.
